cardSpark User Agreement

Welcome to cardSpark (hereinafter referred to as "this App"). Please read and understand this "User Agreement" (hereinafter referred to as "this Agreement") carefully before using this App. By downloading, installing, or using this App, you indicate that you have fully read, understood, and agree to be bound by all the terms of this Agreement. If you do not agree to any part of this Agreement, please stop using this App immediately.

1. App Description

cardSpark is a card-style knowledge management and learning tool that runs on iOS devices. Its main features include:

• Content Creation & Management: Allows users to manually create projects, establish categories within projects, and create cards (entries) containing text and images. You can add more image-text notes to each entry.
• Data Storage: All data you create, including projects, categories, entries, and their attached notes and images, is by default stored only locally on your device. This App will not actively upload your core data to our servers.
• Data Backup & Synchronization: This App supports data backup and cross-device synchronization via Apple's iCloud service. This feature relies on Apple's iCloud service. Its availability, data security, and privacy policies adhere to the Apple Media Services Terms and Conditions and Apple's privacy policy. Enabling this feature means you agree to be bound by the relevant terms.
• Data Sharing: You can export and share data from an entire project or a single entry with other users via the share sheet provided by the iOS system. The sharing process is handled by system functions. Please be cautious and only share data with parties you trust.

2. Data & Privacy

We highly value your data security and privacy:

• Data Ownership: All content you create, input, or upload using this App, including intellectual property and related rights, belongs to you. This App merely provides the tools for storing, managing, and displaying this data.
• Local Storage: Your core data is primarily stored locally on your device. We recommend that you regularly back up your data via iCloud or other trusted methods to prevent data loss due to device loss, damage, or app uninstallation. We are not responsible for data loss resulting from your failure to back up.
• iCloud Service: When you enable the iCloud backup/sync feature, your data is processed by Apple Inc. We do not access, collect, or store any data from your iCloud account. Please refer to Apple's relevant policies and terms regarding iCloud data handling.
• Information Collection: To improve the app experience and troubleshoot issues, we may collect crash logs and usage statistics (e.g., feature usage frequency) in an anonymized manner, which do not involve your personal identity or content data. This information cannot be linked to your identity or the specific content of your cards.
• System Sharing: When you use the system sharing function, data transmission occurs directly between you and the recipient. This App does not participate in this transmission process and is not responsible for the recipient's subsequent use of the data.

3. Rules of Use

You agree to abide by the following rules when using this App:

• You must ensure that the content you create, store, and share complies with laws and regulations and does not infringe upon the legitimate rights and interests of any third party (including but not limited to intellectual property rights, portrait rights, and privacy rights).
• You must not use this App to engage in any illegal, harassing, defamatory, fraudulent, or otherwise inappropriate conduct.
• You must not reverse engineer, decompile, disassemble, or attempt to extract the source code of this App.

4. Disclaimer

• This App is provided "as is." The developer makes every effort to ensure the stability and security of the App but makes no express or implied warranties regarding its fitness for purpose, freedom from errors, or uninterrupted operation.
• To the maximum extent permitted by law, we are not liable for any data loss, leakage, or any other damages resulting from force majeure (e.g., network failures, device compatibility issues, system updates), third-party service issues (e.g., iCloud service interruption), or your improper operation (e.g., accidental deletion, failure to back up).
• You are solely responsible for all consequences arising from sharing data through this App.

5. Agreement Modification and Termination

• We reserve the right to update this Agreement at any time. The updated agreement will be posted on this page with a revised effective date. Your continued use of this App constitutes your acceptance of the updated agreement. Please review it periodically.
• You may terminate your use at any time by uninstalling this App. Upon termination, this Agreement will no longer apply to you, but you are responsible for managing any data already stored on your local device or in iCloud.

6. Miscellaneous

• This Agreement is governed by the laws of the People's Republic of China (for the purpose of providing services within Mainland China). Any disputes shall first be resolved through friendly negotiation.
• If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
• This Agreement constitutes the entire agreement between you and the cardSpark developer regarding the use of this App.
